University of Huddersfield Mooting Competition – 3rd November 2022

Our immediate part president, James Staton of Schofield Sweeney Solicitors, presided over the University of Huddersfield’s first mooting competition of the academic year.

The scenario was a breach of contract claim involving issues in relation to implied terms, promissory estoppel and guarantees.  For the purpose of the moot, Jim Staton, who celebrated being admitted as a solicitor 40 years ago on 1 November, was elevated to the appellate bench.   The three teams were acting for the first appellant, a print company which was appealing against findings against it in relation to a contract for the supply of books and a director for that company who was appealing against the decision that she had guaranteed the company’s performance with the respondent, a publisher, contesting the appeals.

Having heard from the two sets of appellants represented by leading and junior counsel in each case, Jim Staton found in favour of the appellants, overturning the lower court verdicts on each of the three points which came before him.
